The Ministry of Environment issues Resolution 0083 of 2026 and exempts electrical distribution infrastructure in forest reserves from subtraction

The Ministry of Environment and Sustainable Development issued Resolution 0083 of February 5, 2026 , through which it unified the activities of low environmental impact and social benefit that can be developed within the forest reserve areas without the need to carry out a subtraction procedure .
The resolution expressly repeals the previous acts (Resolutions 1527 of 2012 and 1274 of 2014) and consolidates a single list of activities, under a logic of real impact, reversibility and collective benefit .
A key adjustment for the energy sector
The activities now expressly recognized include:
“The installation of towers for telecommunications antennas, radar, and for the transmission and distribution of electrical energy, with their respective temporary access points.”
This recognition is particularly relevant because:
It eliminates restrictive interpretations that forced the processing of unnecessary withdrawals,
It reduces time and risks in structuring electrical projects, and
It strengthens the coherence between environmental policy and the provision of essential public services.
This approach coincides with the analysis we had previously put forward when reviewing the draft of the administrative act, in which we noted the need to distinguish between structural impact on the forest and specific low-impact occupations .
Practical implications
Greater legal certainty for transmission and distribution projects.
Reduced procedural burden for environmental authorities.
Reduction of administrative and contentious conflicts.
Resolution 0083 of 2026 thus constitutes a relevant step towards a more technical, functional environmental regulation oriented towards the effective management of risk , without blurring the conservation objectives.
